Permanent Resident

Permanent resident status is obtained upon the approval of the immigrant visa or the adjustment of status. This permanent residency can be obtained through Family Sponsorship, Labor Certification through an employer in the U.S., by National Interest Waiver, or other special category for persons of Extraordinary Ability or the Green Card Lottery (Diversity Visa).

The preference categories have allocated a limited number of visas each year. Individuals are grouped into visa preference categories that are ranked according to the order they are preferred for immigration purposes. Essentially, the higher the preference category, the more quickly an individual will be granted permanent residency status. The following groups are considered preference categories:

Family-sponsored immigrants

  • First Preference – Unmarried sons and daughters of U.S. citizens
  • Second Preference – Spouses and unmarried children and sons and daughters of lawful permanent residents
  • Third Preference – Married sons and daughters of U.S. citizens
  • Fourth Preference – Brothers and sisters of U.S. citizens

Employment-based immigrants

  • First Preference – Priority workers
  • Second Preference – Members of professions holding advanced degrees or aliens of exceptional ability
  • Third Preference – Professionals, skilled, and workers
  • Fourth Preference – Special immigrants
  • Fifth Preference – Employment creation (investors)

Citizenship

U.S. Citizenship is obtained either by birth or naturalization. There are certain benefits to becoming a U.S. citizen, such as higher estate tax exemptions, federal job benefits, greater freedom of travel to other countries and most importantly, the right to vote.

An individual may acquire U.S. citizenship in the following ways:

  • Birth in the United States
  • Birth outside the U.S. to a U.S. citizen parent
  • Naturalization of parents
  • Children born and residing outside the U.S.
  • Adoption by U.S. citizen parents
